Public Accessibility Notice: These Terms of Service are publicly accessible and do not require a login or account to view. A link to these Terms must be included on any SMS opt-in signup form used by Providence REI Group LLC.

1. Overview

These Terms of Service ("Terms") govern your participation in the SMS/text messaging program operated by Providence REI Group LLC ("Company," "we," "us," or "our"), a real estate investment company operating in Alaska. By opting in to receive text messages from us, you agree to these Terms in full.

2. Eligibility

By participating in our SMS program, you represent and warrant that:

You are at least 18 years of age.
You are a licensed real estate agent, broker, or authorized representative of a real estate business.
You are the owner or authorized user of the mobile phone number receiving messages.
You have the legal authority to consent to receive text messages at the number provided.

3. Consent and Opt-In

By providing your mobile phone number and agreeing to receive text messages from Providence REI Group LLC — whether verbally, in writing, electronically, or by any other means — you expressly consent to receive SMS text messages from us at the number provided.

Your consent to receive text messages is not a condition of any purchase, agreement, or business relationship.

4. SMS Messaging Program

This section contains all required disclosures specific to our SMS/text messaging program.

4.1 Program Name

4.2 Product Description

Providence REI Group LLC operates an SMS outreach program through which we contact real estate agents and industry professionals to inquire about properties available for purchase. This is a business-to-business real estate acquisition communication program.

Types of messages sent include:

Inquiries to real estate agents regarding properties currently listed for sale.
Follow-up messages related to specific property leads or listings.
Scheduling messages for property viewings or agent consultations.
General business communications related to real estate acquisition activity.

This program is not a consumer marketing or promotional campaign.

4.3 Message Frequency Disclosure

Message frequency varies based on property activity, market conditions, and the nature of your engagement with our company. You may receive recurring messages as long as you remain opted in to our program. You may opt out at any time (see Section 4.5).

4.4 Message and Data Rates Disclosure

Message and data rates may apply. Standard SMS and data rates charged by your mobile carrier apply to all messages sent and received through this program. Providence REI Group LLC is not responsible for any charges imposed by your carrier. Contact your mobile carrier for details on your plan's messaging rates.

4.5 Opt-Out Instructions

You may withdraw your consent and stop receiving text messages at any time using any of the following methods:

Reply STOP to any text message you receive from us.
Contact us directly using the customer care information in Section 4.6.

Upon receipt of your opt-out request, you will receive one final confirmation message and no further texts will be sent unless you voluntarily re-enroll. Opting out does not affect any other business relationship or agreement between you and Providence REI Group LLC.

6. No Warranties

Our SMS communications are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, timeliness, or uninterrupted delivery of text messages. Message delivery is subject to the performance of third-party carriers and platforms outside our control.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Providence REI Group LLC shall not be liable for:

Any failure to deliver or delays in text message delivery.
Costs or charges imposed by your mobile carrier.
Any indirect, incidental, special, or consequential damages arising from your participation in our SMS program.

Our total liability for any claim arising under these Terms shall not exceed the amount, if any, paid by you to us in connection with the matter giving rise to the claim.

8. Compliance with Applicable Law

Providence REI Group LLC operates its SMS program in compliance with applicable federal and state laws and regulations, including:

The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227.
FCC regulations implementing the TCPA.
The CAN-SPAM Act (where applicable).
Applicable Alaska state laws governing electronic communications and privacy.

We reserve the right to modify or discontinue the SMS program at any time to maintain legal compliance.

9. Changes to These Terms

We reserve the right to update these Terms at any time. Changes are effective upon posting the revised Terms with an updated effective date. We encourage you to review these Terms periodically. Continued participation in the SMS program after changes are posted constitutes your acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Alaska and applicable federal law. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts located in Alaska.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
